OVERVIEW

Welcome to Gemiria. These Terms of Service ("Terms") govern your use of our website at gemiria.com and all products and services provided by Danley-Global Bt., trading as Gemiria.

By visiting our website or making a purchase, you agree to these Terms and our Privacy Policy. If you do not agree, you should not use our Services.


1. ELIGIBILITY & ACCOUNT INFORMATION

By using our Services, you confirm that:

  • You are at least 16 years old, or using the Services with parental/guardian consent
  • You have the legal capacity to enter into a binding contract
  • All information you provide is accurate and current
  • You are authorized to use the payment method you submit

If you create an account, you are responsible for safeguarding your login details and for all activity under your account.


2. CUSTOM JEWELRY & PERSONALIZED PRODUCTS

Most Gemiria jewelry is custom-made to your specifications.

MATERIALS

All Gemiria jewelry is made from 304 stainless steel with PVD coating (for gold and rose gold finishes). We do not use real gold, real silver, or precious metals. Our jewelry is hypoallergenic, nickel-free, and waterproof.

CUSTOMIZATION ACCURACY

You are responsible for:

  • Verifying the accuracy of all custom text (names, words, characters) before submitting your order
  • Ensuring correct spelling, script selection, and font choice
  • Double-checking your order confirmation email within 24 hours

We will create your jewelry exactly as you specify. If you submit incorrect text or select the wrong script/font, we are not responsible for the error unless we made a mistake in production.

CUSTOMIZATION LIMITATIONS

Once you submit customization details (names, text, characters, or designs), your order enters production within 24 hours.

Custom-made jewelry cannot be returned, exchanged, or canceled once production begins, except if the item is defective or we made an error.

We reserve the right to decline customizations containing:

  • Profanity or offensive language
  • Hate speech or discriminatory content
  • Copyrighted or trademarked text (without authorization)
  • Prohibited symbols or imagery

VISUAL REPRESENTATION

Product photos are representative examples only and do not depict your specific customization. Actual jewelry is custom-made with your name and selected options.

Product colors, finishes, sizes, letter shapes, and connections may vary from images due to:

  • Screen settings and calibration
  • Lighting conditions in photos
  • Your specific name and characters
  • Handmade nature of custom jewelry

By placing an order, you acknowledge that custom jewelry may vary from images shown. All custom jewelry is covered by our 2-year warranty.


3. ORDERS & CANCELLATIONS

ORDER ACCEPTANCE

By placing an order, you are making an offer to purchase. We reserve the right to accept or refuse any order for any reason, including but not limited to:

  • Product availability
  • Errors in pricing or product information
  • Suspected fraud or unauthorized transactions

ORDER CANCELLATIONS

  • Custom/personalized items: Cancellable only within 24 hours of purchase
  • After 24 hours, customization begins and the order cannot be canceled
  • To request cancellation, email info@gemiria.com immediately with your order number

ORDER MODIFICATIONS

Customization details (names, text, font, script, finish) cannot be modified after 24 hours from order placement.


4. PRICING & PAYMENT

PRICES

  • All prices are shown in local currencies or in Euros (€)
  • Prices include VAT (Value Added Tax) for EU customers
  • Prices may change without notice
  • The price shown at checkout is the final price

PAYMENT

By completing payment, you confirm that:

  • Your payment details are accurate
  • You are authorized to use the selected payment method
  • You agree to pay all amounts due, including product price, shipping, and applicable taxes

Payment is processed securely through Shopify Payments and third-party payment providers.


5. SHIPPING & DELIVERY

DELIVERY TIMEFRAMES

All Gemiria jewelry is custom-made to order. Your total delivery time includes production time + shipping time.

Production time: 2–5 days
Your piece is handcrafted and quality-checked before shipping.

Shipping time: Most orders arrive within:

  • Western Europe (Germany, France, Netherlands, Belgium): 7–14 days typically
  • UK & Southern Europe (Spain, Italy, Portugal): 10–21 days typically
  • Eastern Europe & Scandinavia: 14–28 days typically
  • North America: 12–26 days typically
  • Asia & Oceania: 14–35 days typically
  • Rest of World: 14–35 days typically

Total delivery: Most customers receive their jewelry within 7–28 days from order date. Remote regions or customs delays may extend delivery up to 40 days.

All timeframes are estimates in business days and may vary due to customs inspections, peak seasons, or carrier delays beyond our control.

SHIPPING COSTS

  • Standard shipping: €4.90 per order (or equivalent in your local currency)
  • Free shipping: On orders €50 or more (or equivalent in your local currency)
  • Express shipping: May be available at checkout for select regions

TRACKING

You will receive a tracking number via email when your order ships. Tracking updates may take 24–48 hours to appear in the carrier's system.

International tracking may have limited visibility during transit. If tracking has not updated in 10 days, contact us.

DELIVERY ISSUES

If your order:

  • Does not arrive within 45 days: Contact us immediately
  • Arrives damaged: Take photos and email us within 7 days
  • Is stuck in customs: We will assist with documentation
  • Is lost in transit: We will investigate and offer replacement or refund

RISK OF LOSS

For EU/UK consumers: Risk transfers only upon delivery to you.

For international customers outside the EU/UK: Risk is determined by local consumer law.

Regardless of destination, we assist in investigating lost or damaged packages and may offer a replacement or refund when appropriate.


6. RETURNS & REFUNDS

PERSONALIZED ITEMS EXCLUSION

Under EU Consumer Rights Directive Article 16(c), personalized goods made to your specifications are excluded from the standard 14-day right of withdrawal.

This means custom jewelry with your chosen name, text, or design cannot be returned for a refund simply because you changed your mind.

WHEN WE ACCEPT RETURNS

We DO accept returns and offer replacements or refunds if:

  • Item arrives damaged or defective
  • We made an error in production (wrong name, wrong finish, wrong product)
  • Item is significantly different from our description
  • Item has a manufacturing defect covered by warranty

HOW TO REQUEST A RETURN

  1. Email info@gemiria.com within 14 days of delivery
  2. Include your order number and photos of the issue
  3. We will respond within 2 business days
  4. If approved, we'll provide return instructions or send a replacement

REFUND PROCESS

Approved refunds are processed within 5-7 business days to your original payment method.


7. WARRANTY

STANDARD 2-YEAR WARRANTY (INCLUDED FREE)

All Gemiria jewelry includes a 2-year commercial warranty covering:

  • Manufacturing defects
  • Premature tarnishing or discoloration
  • Chain or clasp breakage under normal wear
  • Material defects (flaking PVD coating, metal corrosion)

NOT COVERED BY WARRANTY:

  • Normal wear and tear
  • Damage from misuse, abuse, or harsh chemicals
  • Damage from alterations or repairs by third parties
  • Loss or theft
  • Scratches from daily wear

5-YEAR EXTENDED WARRANTY (OPTIONAL UPGRADE)

At checkout, you may purchase Extended Warranty for €9.90:

  • Extends coverage to 5 years total (adds 3 years to standard 2-year warranty)
  • Covers all issues included in standard warranty
  • Same coverage terms, longer protection period

HOW TO MAKE A WARRANTY CLAIM

  1. Email info@gemiria.com with your order number, photos of the issue and description of the problem
  2. We will review within 2 business days
  3. If approved, we'll send a free replacement or offer a refund (your choice)

This commercial warranty is in addition to, and does not limit, your statutory consumer rights under EU and Hungarian law.


8. INTELLECTUAL PROPERTY

WEBSITE CONTENT

All content on our website—including images, text, product designs, logos, custom illustrations, and graphics—is the property of Danley-Global Bt. or licensed to us.

You may not:

  • Copy, reproduce, or distribute our content
  • Create derivative works
  • Use our content for commercial purposes without our written permission.

K-POP & CELEBRITY NAMES DISCLAIMER

Gemiria uses K-pop group names, artist names, and idol names for descriptive and informational purposes only.

  • We are NOT affiliated with, endorsed by, or connected to any K-pop groups, artists, management companies, or entertainment agencies
  • Our products are fan-made custom jewelry, not official merchandise
  • All trademarks and copyrights belong to their respective owners

We respect intellectual property rights and will remove content upon valid request from rights holders.

CUSTOMER CONTENT

If you submit reviews, photos, or other content (user-generated content), you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display this content for marketing or promotional purposes.

You confirm that:

  • You own or control the rights to the content you submit
  • Your content does not infringe the rights of others
  • Your content does not violate these Terms

We may remove inappropriate or unlawful content at our discretion.


9. THIRD-PARTY TOOLS & LINKS

Our Services may include tools, apps, or embedded services from third-party providers, such as:

  • Payment processors (Shopify Payments, PayPal, Stripe)
  • Customization platforms
  • Analytics tools (Google Analytics, Meta Pixel)
  • Shipping calculators

We do not control these third parties and are not responsible for:

  • Their content or policies
  • Their performance or availability
  • Data they collect from you

Use of third-party tools is at your own risk. Review their terms and privacy policies.

SHOPIFY PLATFORM

Our store is powered by Shopify. Shopify is not a party to your transaction and is not responsible for issues related to your purchase.

By using our Services, you agree to:

Danley-Global Bt. and Gemiria as w whole (its directors, employees, and agents) are NOT liable for:

  • Indirect or consequential damages
  • Lost profits, revenue, or business opportunities
  • Lost data or information
  • Business interruption
  • Reputational harmarising from or related to:

  2. Inability to use our Services
  3. Defective products (beyond warranty coverage)
  4. Delays in delivery
  5. Third-party services or links

CONSUMER RIGHTS NOT LIMITED

Nothing in these Terms limits or excludes:

  • Liability for death or personal injury caused by negligence
  • Liability for fraud or fraudulent misrepresentation
  • Your statutory consumer rights under applicable law

14. INDEMNIFICATION

You agree to indemnify and hold harmless Danley-Global Bt. and its representatives from any claims, damages, or expenses (including legal fees) resulting from:

  • Your breach of these Terms
  • Your misuse of the Services
  • Your violation of third-party rights
  • Content you submit to our Services

15. TERMINATION

We may suspend or terminate your access to our Services at any time, with or without notice, for:

  • Violations of these Terms
  • Suspected fraud or abuse
  • Legal or regulatory requirements

Upon termination:

  • Existing orders will be processed or canceled at our discretion
  • Outstanding balances remain due

16. GOVERNING LAW & DISPUTES

GOVERNING LAW

These Terms are governed by the laws of Hungary.

CONSUMER RIGHTS

EU consumers may bring legal proceedings in their country of residence, as required by EU consumer-protection law (Regulation 1215/2012).

Hungarian consumers have rights under Hungarian consumer protection law (Act CLV of 1997 on Consumer Protection).

DISPUTE RESOLUTION

Before initiating legal proceedings, we encourage you to contact us at info@gemiria.com to resolve disputes amicably.

17. FORCE MAJEURE

We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including:

  • Natural disasters (earthquakes, floods, fires)
  • War, terrorism, or civil unrest
  • Strikes or labor disputes
  • Government actions or regulations
  • Pandemics or public health emergencies
  • Internet or telecommunications failures
  • Supplier failures

18. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.


19. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Danley-Global Bt. regarding use of our Services.


20. CHANGES TO TERMS

We may update these Terms at any time. Changes become effective when posted on our website.

Continued use of our Services after changes constitutes your acceptance of the revised Terms.

For material changes, we will provide notice via email or prominent website notice.
