OVERVIEW
Welcome to Gemiria. These Terms of Service ("Terms") govern your use of our website at gemiria.com and all products and services provided by Danley-Global Bt., trading as Gemiria.
By accessing our website or placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, you should not use our Services.
1. ELIGIBILITY & ACCOUNT INFORMATION
By using our Services, you confirm that:
- You are at least 16 years old, or using the Services with parental or guardian consent
- You have the legal capacity to enter into a binding contract
- All information you provide is accurate and current
- You are authorized to use the payment method submitted
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and all activity under your account.
2. CUSTOM JEWELRY & PERSONALIZATION
Most Gemiria jewelry is custom-made to your specifications.
MATERIALS
All Gemiria jewelry starts with a 304 surgical-grade stainless steel base. Gold and Rose Gold finishes are coated with 18K PVD plating. Silver is finished with rhodium, one of the rarest precious metals in the world, valued for its brilliant finish and exceptional durability.
We do not use solid gold or solid silver. Our jewelry is hypoallergenic, nickel-free, and designed for everyday wear including showering, swimming, and exercise.
CUSTOMIZATION ACCURACY
You are responsible for:
- Verifying the accuracy of all custom text (names, words, characters) before submitting your order
- Ensuring correct spelling, script, font, and size selection
- Reviewing your order confirmation email within 24 hours
We manufacture your jewelry exactly as submitted. Errors resulting from incorrect customization details provided by the customer are not our responsibility unless caused by us.
CUSTOMIZATION LIMITATIONS
Because Gemiria jewelry is custom-made, orders enter production shortly after purchase. Once production begins, custom-made items cannot be canceled, modified, or exchanged.
This does not affect your rights if an item is defective, damaged, or produced incorrectly.
We reserve the right to decline customizations that contain:
- Profanity or offensive language
- Hate speech or discriminatory content
- Copyrighted or trademarked text without authorization
- Prohibited symbols or imagery
VISUAL REPRESENTATION
Product images on our website are representative examples intended to showcase style, material, and finish.
Because each piece is custom-made, the final product may differ slightly due to:
- Your specific name or characters
- Script and font characteristics
- Hand-finishing of each piece
- Lighting and screen differences
These variations are normal and part of personalized jewelry craftsmanship.
3. ORDERS & CANCELLATIONS
ORDER ACCEPTANCE
By placing an order, you are making an offer to purchase. We reserve the right to accept or refuse any order for reasons including product availability, pricing errors, or suspected fraud.
ORDER CANCELLATIONS
Custom and personalized orders may be canceled within 24 hours of purchase, provided production has not yet begun.
Once production starts, the order can no longer be canceled due to its personalized nature. Therefore, we cannot guarantee cancellation requests submitted after 24 hours.
To request a cancellation, contact info@gemiria.com as soon as possible with your order number.
ORDER MODIFICATIONS
Customization details (name, text, font, script, finish) cannot be modified after 24 hours from order placement.
4. PRICING & PAYMENT
PRICES
- Prices are displayed in Euros (€) or your local currency
- No VAT is charged at checkout
- Prices may change without notice
- The price shown at checkout is the final product price
PAYMENT
By completing payment, you confirm that:
- Your payment details are accurate
- You are authorized to use the selected payment method
- You agree to pay all amounts due, including product price, shipping, and applicable taxes
Payments are processed securely via Shopify Payments and third-party payment providers.
5. SHIPPING & DELIVERY
All Gemiria jewelry is custom-made to order. Total delivery time includes production and shipping.
Production time: 4-5 business days Each piece is laser-cut, finished by hand, and quality-checked before shipping.
Delivery time: We deliver worldwide. Most orders arrive within 1-2 weeks of shipping, in rare cases longer for remote areas.
All timeframes are estimates and may vary due to customs inspections, peak seasons, or carrier delays beyond our control.
Orders are produced and shipped from Asia through our international fulfillment partners.
Tracking details are provided by email once your order ships.
If an order is significantly delayed beyond the estimated timeframe, please contact info@gemiria.com and we will assist.
RISK OF LOSS
- EU/UK customers: Risk transfers only upon delivery
- Customers outside the EU/UK: Risk is determined by local consumer law
Regardless of destination, we assist in investigating confirmed delivery issues and may offer a replacement or refund when appropriate.
6. RETURNS & REFUNDS
Returns, refunds, and withdrawal rights are governed by our Refund Policy, which forms part of these Terms.
Personalized items are excluded from the right of withdrawal under EU Consumer Rights Directive Article 16(c), except in cases of defects or production errors.

7. WARRANTY
LIFETIME WARRANTY
All Gemiria jewelry includes a lifetime warranty covering:
- Manufacturing defects
- Premature tarnishing or discoloration
- Chain or clasp breakage under normal wear
- Structural issues related to material or craftsmanship
The warranty does not cover:
- Loss or theft
- Damage caused by misuse, accidents, or improper care
- Normal cosmetic wear such as minor scratches
- Damage caused by third-party alterations or repairs
To make a warranty claim, contact info@gemiria.com with your order number and photos of the issue.
This lifetime warranty is a commercial warranty and does not limit or replace your statutory consumer rights under applicable EU and Hungarian law.
8. INTELLECTUAL PROPERTY
All website content, including images, text, designs, logos, and graphics, is the property of Danley-Global Bt. or licensed to us.
You may not copy, reproduce, distribute, or commercially use our content without written permission.
K-POP & CELEBRITY NAMES DISCLAIMER
Gemiria uses artist and group names for descriptive purposes only. We are not affiliated with, endorsed by, or connected to any artists, agencies, or entertainment companies.
All trademarks belong to their respective owners.
9. THIRD-PARTY TOOLS & LINKS
Our Services may include third-party tools such as payment processors, analytics, or customization software. We do not control these third parties and are not responsible for their content, policies, or performance.
Our store is powered by Shopify. Shopify is not a party to your transaction.
10. PRIVACY & DATA PROTECTION
Personal data is processed according to our Privacy Policy. By using our Services, you agree to the collection and processing of your data as described therein.
11. PROHIBITED USES
You may not use our Services to violate laws, infringe rights, engage in fraud, distribute malware, or disrupt our systems.
We may suspend or terminate access for violations.
12. DISCLAIMER OF WARRANTIES
Our Services and products are provided "AS IS" and "AS AVAILABLE" to the fullest extent permitted by law.
This disclaimer does not limit your statutory consumer rights.
13. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Danley-Global Bt. and Gemiria as a whole are not liable for indirect or consequential damages, lost profits, business interruption, or third-party services.
Nothing in these Terms limits liability for death, personal injury, fraud, or mandatory consumer protections.
14. INDEMNIFICATION
You agree to indemnify and hold harmless Danley-Global Bt. from claims arising from your misuse of the Services or violation of these Terms.
15. TERMINATION
We may suspend or terminate access to the Services for violations, suspected fraud, or legal requirements.
16. GOVERNING LAW & DISPUTES
These Terms are governed by the laws of Hungary.
EU consumers may bring legal proceedings in their country of residence. Hungarian consumer protection law applies where relevant.

17. FORCE MAJEURE
We are not liable for failure to perform obligations due to events beyond reasonable control, including natural disasters, strikes, or governmental actions.
18. SEVERABILITY
If any provision is found unenforceable, the remaining provisions remain in effect.
19. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and related policies, constitute the entire agreement between you and Danley-Global Bt.
20. CHANGES TO TERMS
We may update these Terms at any time. Continued use of the Services constitutes acceptance of changes.
